Terms of Service

Please read these before using Audered. By creating an account or using the app, you agree to them.

1. Who we are

Audered is a card game for couples developed and operated by Daniel Farré. These terms govern your access to and use of the Audered mobile app and related services (the "Service"). Questions about them go to Show email .

2. Who can use it

You must be 18 or older. By using the Service you confirm that you meet that requirement. Some cards are explicitly adult in content.

3. Your account

To use Audered you need an account, created with a valid email, with Google or with Apple (on iPhone). You are responsible for:

  • Keeping your credentials safe and not sharing them.
  • Everything that happens from your account.
  • Telling us promptly if you suspect someone else has got into it.

We may close accounts that breach these terms.

4. What the Service does

Audered lets you and your partner play cards together in real time:

  • Linking up with an invite code.
  • Choosing a deck and how long each game lasts.
  • Receiving a hand of cards and playing them.
  • Cancelling or answering cards with wildcards.
  • Looking up your shared history.
  • Customising your profile and photo.

We may change, suspend or withdraw features at any time. Where a change is significant, we will try to give notice in advance.

5. Purchases

Each person's first game is free, with the free deck, and lasts one week. After that, every new game is played in one of two ways:

  • Single game: a one-off payment for one game with the deck you choose. One of you pays and you both play. The purchase is used up when the game starts and does not renew.
  • Audered Plus: a monthly or yearly subscription. While it is active, the couple can start as many games as they like, with any deck and mixing decks. Only one of you needs to have it.

The price and length of each option are shown in the app before you pay, including any applicable taxes.

How long a game lasts

When you start it, you choose whether it lasts a week, a month or three months; the free game lasts a week. It ends when every card has been played or when time runs out. If time runs out with cards left, you can keep going with the same ones: in a single game or with Audered Plus it costs nothing, and in the free game it takes the one-more-week purchase, a one-off payment that extends it by seven days.

Audered Plus renewal and cancellation

  • The subscription renews automatically at the end of each period, for the same period and at the current price, unless you cancel at least 24 hours before it ends.
  • Payment is charged to your App Store or Google Play account when you confirm the purchase and at each renewal.
  • You cancel in the subscription settings of your App Store or Google Play account, not in Audered. After cancelling, Audered Plus stays active until the end of the period already paid for, and you are not charged again.
  • Deleting the app or your Audered account does not cancel the subscription: you have to cancel it in the store.
  • If we change the price, the store will tell you beforehand and you can cancel if you do not agree.

Refunds

Payment is handled by the App Store or Google Play. Refunds are requested from whichever store you bought from and follow its terms, not ours. If the store refunds a single game that has not been played, that game is no longer available. None of this limits the rights the law gives you as a consumer.

If you unlink

  • Unlinking from your partner deletes the game in progress and your shared history. A single game that has already started is not given back: it was used up when the game began.
  • A single game that was bought and not yet started still belongs to whoever bought it, and they can use it with a new partner.
  • Audered Plus belongs to the person who pays for it. After unlinking it stays active for that person and no longer covers the other.

Purchases are tied to your store account and your Audered account. If you change phones, "Restore purchases" brings them back. If you have paid and it has not been activated, write to us and we will sort it out. If you delete your account, any single games you have not started are deleted with it and are not refunded.

6. Acceptable use

You agree not to:

  • Use the Service for anything unlawful.
  • Try to gain unauthorised access to any part of the Service or its infrastructure.
  • Reverse-engineer, decompile or otherwise extract the app's source code.
  • Transmit malware, viruses or any harmful code.
  • Use the Service to harass, threaten or harm anyone.
  • Harvest data from the Service in an automated way.

And one that goes without saying but is worth writing down: a card is a proposal, not an obligation. Nothing a card says replaces the other person's consent, at any point and for anything.

7. Intellectual property

The content, design, graphics and code of the Service are ours or licensed to us. You get a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes. Nothing here transfers any intellectual property rights to you.

8. Privacy

Your use of Audered is also governed by our privacy policy, which forms part of these terms.

9. Third-party services

Audered relies on Google Firebase (authentication and notifications), on Cloudflare (the API, the database and profile photos), on RevenueCat (purchases) and on PostHog (usage analytics, which you can turn off in Settings). Your use of the Service is also subject to those providers' terms. We are not responsible for their practices.

10. No warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

We do not warrant that the Service will run without interruption or error. None of this affects the rights consumer law gives you, which cannot be waived.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAD BEEN ADVISED THAT THEY WERE POSSIBLE. None of this limits liability that the law does not allow to be limited, such as wilful misconduct or personal injury.

12. Ending it

You can stop using Audered and delete your account whenever you want, from Settings or by following these instructions. We may suspend or close your access if you breach these terms.

On termination, your right to use the Service ends immediately. Clauses that by their nature should survive will continue to apply.

13. Changes to these terms

We may update them. When we do, we will change the date at the top. Continuing to use the Service after a change means you accept the new version.

14. Governing law

These terms are governed by Spanish law. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country where you live, nor of your right to bring proceedings in your local courts.
