Terms of Service

Please read these before using Audered. By creating an account or using the app, you agree to them.
1. Who we are
Audered is a card game for couples developed and operated by Danilo Farré. These terms govern your access to and use of the Audered mobile app and related services (the "Service"). Questions about them go to support@audered.com.
2. Who can use it
You must be 18 or older. By using the Service you confirm that you meet that requirement. Some cards are explicitly adult in content.
3. Your account
To use Audered you need an account, created with a valid email or with Google. You are responsible for:
- Keeping your credentials safe and not sharing them.
- Everything that happens from your account.
- Telling us promptly if you suspect someone else has got into it.
We may close accounts that breach these terms.
4. What the Service does
Audered lets you and your partner play cards together in real time:
- Linking up with an invite code.
- Receiving a hand of cards and playing them.
- Cancelling or answering cards with wildcards.
- Looking up your shared history.
- Customising your profile and photo.
We may change, suspend or withdraw features at any time. Where a change is significant, we will try to give notice in advance.
5. Purchases
You start free with a trial deck. The full catalogue unlocks with a single payment that covers the couple: one of you pays and it opens for both. There is no subscription and nothing renews.
Payment is handled by the App Store or Google Play, and refunds follow the terms of whichever store you bought from, not ours. If you have paid and it has not unlocked, write to us and we will sort it out.
6. Acceptable use
You agree not to:
- Use the Service for anything unlawful.
- Try to gain unauthorised access to any part of the Service or its infrastructure.
- Reverse-engineer, decompile or otherwise extract the app's source code.
- Transmit malware, viruses or any harmful code.
- Use the Service to harass, threaten or harm anyone.
- Harvest data from the Service in an automated way.
And one that goes without saying but is worth writing down: a card is a proposal, not an obligation. Nothing a card says replaces the other person's consent, at any point and for anything.
7. Intellectual property
The content, design, graphics and code of the Service are ours or licensed to us. You get a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes. Nothing here transfers any intellectual property rights to you.
8. Privacy
Your use of Audered is also governed by our privacy policy, which forms part of these terms.
9. Third-party services
Audered relies on Google Firebase (authentication, profile photos and notifications), on our own server hosted with Oracle Cloud (database) and on RevenueCat (purchases). Your use of the Service is also subject to those providers' terms. We are not responsible for their practices.
10. No warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
We do not warrant that the Service will run without interruption or error. None of this affects the rights consumer law gives you, which cannot be waived.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAD BEEN ADVISED THAT THEY WERE POSSIBLE. None of this limits liability that the law does not allow to be limited, such as wilful misconduct or personal injury.
12. Ending it
You can stop using Audered and delete your account whenever you want, from Settings or by following these instructions. We may suspend or close your access if you breach these terms.
On termination, your right to use the Service ends immediately. Clauses that by their nature should survive will continue to apply.
13. Changes to these terms
We may update them. When we do, we will change the date at the top. Continuing to use the Service after a change means you accept the new version.
14. Governing law
These terms are governed by Spanish law. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country where you live, nor of your right to bring proceedings in your local courts.
